TERMS OF USE
General conditions of "Koda Production" EOOD for participation in the World Stars Salsa Festival event and for individual hotel reservations (HR) and their sale to end customers - tourists
I. PARTICIPATION IN THE EVENT
1. Conditions for registration and participation in the event:
1.1. Registration for participation in the event is carried out electronically, in accordance with the present general terms and conditions.
1.2. The reservation for participation in the event is considered valid after filling in the registration form (reservation form). The reservation is considered confirmed and guaranteed only after payment of 100% of the total amount for all tickets.
1.3. After making the reservation and its confirmation, the User will receive an electronic ticket for participation in the event. Tickets are registered and issued in the name of the user. The electronic ticket is sent to the e-mail address specified by the user, after payment of the full amount of the price due.
1.4. The participation ticket is valid only for the event for which it was purchased and cannot be exchanged for a voucher.
1.5. The ticket for participation in the World Stars Salsa Festival event binds "Koda Production" EOOD to fulfill its obligations only upon full payment of the due amount.
1.6. The person who purchased the tickets represents the interests of all Users whose names appear on them, being responsible for their personal data, as well as for the fulfillment of all obligations under the contract.
1.7. During the event, the User may be photographed and videotaped, and these materials may be used publicly for advertising and/or marketing purposes. By purchasing the ticket, the User declares that he has been notified of such action and gives his express and irrevocable consent.
1.8. The user has the right to access the event only upon presentation of a personal ticket and an identity document.
1.9. The user is required to wear the distinctive wristband throughout the event. The user is responsible for maintaining the integrity of the bracelet. In the event of a problem, the User can receive a new bracelet only upon presentation of the old one.
II. RESERVATION OF HOTEL ACCOMMODATION
1. Reservation and conditions for hotel accommodation of the participants in the event.
1.1. Reservation for hotel accommodation is made electronically, in accordance with the present general terms and conditions.
1.2. The participants in the event can make a reservation for hotel accommodation during its holding, in the accommodation places offered by the Tour Operator, in accordance with the current general conditions.
1.3. Hotel accommodation during the event is part of the travel package related to participation in the event and is offered only to persons who have purchased and/or hold tickets for participation.
1.4. If a user wishes to make an accommodation reservation in the presence of an already purchased ticket for participation in the event, the number of the ticket for participation in the event must be entered.
1.5. The reservation for hotel accommodation is considered valid after filling in the reservation form. The reservation is considered confirmed and guaranteed only after payment of 100% of its value. If the initially requested hotel is not confirmed, the Tour Operator may offer the User other accommodation options. In the event that the User does not accept the other options, he has the right to be reimbursed the amount paid for the hotel accommodation.
1.6. Early bookings are valid with booking and payment made within the advertised promotional dates.
1.7. The user is obliged to indicate the number of persons, the number of nights and the type of accommodation he wishes.
1.8. The tour operator establishes the prices and all other conditions of the sold hotel reservations and promptly takes the necessary measures for the notification of their changes.
1.9. The contract for individual hotel reservation (CIHR) binds "Koda Production" EOOD to fulfill its obligations only upon full payment of the due amount.
1.10. By signing the CIHR, the User declares that he has familiarized himself with the present General Terms and Conditions and has received the information about the offered combination of tourist services, representing a tourist package within the meaning of Art. 82 of the Law on Tourism.
1.11. The person who signed the CIHR represents the interests of all Tourists whose names appear in the contract, being responsible for their personal data, as well as for the fulfillment of all obligations under the contract, as well as assisting third parties to provide assistance in carrying out the trip.
1.12. The tour operator has the right to change the final price in the contract, only in case of a sharp change in the exchange rate of the euro or the US dollar to the Bulgarian lev by more than 5% /five percent/ in the period of signing this contract until the date of accommodation.
1.13. The tour operator undertakes the obligation to make a hotel reservation, according to the User's requirements. The User is obliged to provide full assistance to the Tour Operator, including by providing the necessary information for the various types of hotel reservations.
1.14. The tour operator undertakes, after making the reservation and its confirmation, to provide the User with a Tourist Voucher, as well as all the necessary information related to the accommodation, stay and departure from the place of accommodation.
1.15. The tour operator undertakes to notify the User immediately in the event that all the latter's requirements regarding the place of accommodation cannot be met, in which case it offers the User options:
A) accommodation of the same or higher category specified by the User. In case of a higher total price of the hotel reservation, the difference is borne by the Tour Operator.
B) in case of impossibility of accommodation of the same or higher category, a lower category specified by the User is offered. In case of a lower total price of the hotel reservation, the difference is refunded to the User.
1.16. In case of cancellation of the reservation for reasons due to the place of accommodation or force majeure, the Tour Operator undertakes to notify the User immediately after receiving the information. The tour operator undertakes to assist the User in recovering the amount paid by him. The Tour Operator does not owe a refund of the remuneration received from the User for the booking service, if any, nor any compensation.
1.17. The tour operator has the right to exchange the hotel with one of the same or higher category, without changing the total price of the hotel reservation, which is not considered a material change of the contract.
1.18. The tour operator has the right to replace the hotel with one of a lower category, with a change in the total price of the hotel reservation, in which case the difference will be refunded to the User, which is not considered a material change to the contract.
1.19. The user has no right to cancel the already made reservation. If the User wants to cancel the reservation made, the same has the right to transfer it to a third party in accordance with section IV of these General Terms and Conditions, subject to the conditions specified therein. In the event that the reservation transfer conditions are not met, the rules of Section VII below shall apply.
III. PRICES AND PAYMENTS
1. The prices of the offered tickets are announced in euros.
2. The prices of the offered hotels are announced in euros. Prices include all local and tourist taxes.
3. The prices for accommodation of the participants in the event are promotional and are valid only for the persons who have purchased or have tickets for participation in the event.
4. The user is obliged to make the payments within the terms of this contract and/or indicated in the reservation system. Changes in the method and terms of payment can only be made with an additional agreement between the parties. In case of late payment, the Tour Operator has the right to cancel the reservation. 5. With the acceptance of these general terms and conditions, the user is considered informed in writing about the terms and conditions of payment.
IV. ASSIGNMENT OF USER RIGHTS TO THIRD PARTIES
1. The user has the right, no later than two weeks before the start date of the event, to transfer his rights and obligations under the contract, as a participant in the event, to a third party, by notifying the Tour Operator in writing and remaining jointly and severally responsible for all resulting obligations. In these cases, the User owes the Tour Operator a fee of 20 euros, for each changed ticket, which is due in connection with the change made.
2. The user has the right, no later than two weeks before the start date of the hotel reservation, to transfer his rights and obligations under the contract to a third party - another participant in the event, only if the corresponding means of accommodation allows a change of names on a reservation already made, by notifying the Tour Operator in writing and remaining jointly and severally liable for all resulting obligations, and the acquirer has the right to use the services under the terms of the contract concluded by the transferee and in accordance with these general terms and conditions. In these cases, the User owes the Tour Operator all possible costs arising from the change made.
3. The user can transfer his rights and obligations under this contract once.
4. The user has no right to resell his rights to participate in the event and for hotel accommodation to third parties, in order to make a profit.
5. The tour operator is not committed to finding a third party to transfer rights and obligations under the contract.
6. A user who has purchased a ticket to participate in the event and has concluded a CIHR cannot assign to third parties his rights only in relation to participation in the event or only in relation to hotel accommodation.
V. CHANGES RELATING TO THE EVENT
1. The tour operator has the right to change the list of artists, the date and place of the event, which is not considered a material change of the contract and for which the User is considered to give his consent.
2. In case of a change regarding the event, the User does not have the right to cancel the already made reservation, if the change does not lead to an increase in the price for participation and/or accommodation. If the User wants to cancel the reservation made, he has the right to transfer it to a third party in accordance with the present General Terms and Conditions, subject to the conditions specified therein. In the event that the conditions for transferring the reservation are not met, the penalty specified below in item 1 and item 2 of section VII shall be applied.
VI. COMPLAINTS
1. The User's complaints related to the provision of services - part of the event, must be made in writing within 14 days from the last day of the event. The tour operator examines the received complaint within one month.
2. In case of inaccurate performance of the contract for individual hotel accommodation, established during the stay in the relevant place of accommodation, the User is obliged to immediately notify and familiarize the Tour Operator with the problem that has arisen. All complaints are noted at the place of accommodation itself, by drawing up a Statutory Protocol, signed by persons competent or authorized to certify the relevant facts and circumstances. The tour operator will not accept complaints without written evidence from the hotel or from another supplier of the tour operator, for lack of service or poor quality service
3. In the event that the User has not submitted the complaint in the manner described in item 1 and/or item 2 above, his claims will not be accepted and considered by the Tour Operator.
4. Filing a complaint is a prerequisite for seeking legal liability under the application of the relevant norms of Bulgarian law.
VII. PENALTIES AND LIABILITY OF THE PARTIES
1. In case of refusal and/or inability of the User to use the ticket for participation in the event, for reasons that are not related to the failure of the Tour Operator to fulfill its obligations, the user owes a penalty in the amount of 100% of the amounts paid.
2. If the User refuses the hotel reservation for reasons that are not related to the failure of the Tour Operator to fulfill its obligations, the user owes a penalty in the amount of 100% of the amounts paid. The non-arrival of the persons subject to accommodation according to the CIHR or any of them is considered a refusal by the user.
3. The tour operator is not responsible in case of violation of the legislation of the relevant country by the User, as well as when, by a decision of the authorities or responsible persons, the User is denied the opportunity to leave or enter a country related to the holding of the event and the hotel reservation, and also the possibility of transportation or stay, as a result of which the User could not use the paid ticket and/or the hotel reservation made and paid for.
4. The tour operator is not responsible when the User does not show up for the event and/or for accommodation at the hotel, or if the User voluntarily decides not to use the ticket and/or hotel reservation. In this case, the User's actions are considered a No Show and the paid sums are not refunded, but retained by the tour operator as a penalty.
5. The tour operator does not compensate the value of the services that were available to the User, but the latter did not take advantage of them, regardless of the reasons that led to this.
6. The tour operator is responsible for the performance of the tourist services in the order and in the amounts specified in art. 90 and art. 91 of the Law on Tourism.
7. In the event of damage caused by the User to the inventory of the Tour Operator and/or third parties (own or hired), the User shall pay the damage at retail prices to the Tour Operator or the injured party.
8. The tour operator is not responsible for unconfirmed hotel reservations when the original conditions of the reservation are changed, at the User's request.
9. The tour operator is not responsible for circumstances that could cause inconvenience to the User, even when they are caused by the actions of third parties (for example: noise from the Maritim Paradise Blue Hotel, noise from restaurants or private events, construction works in close proximity to the hotel, etc.). By signing these General Terms and Conditions, the User declares that he is aware of the possibility that such circumstances may occur, and in the event that such circumstances occur, it will not be considered a breach of contract by the Tour Operator.
10. The tour operator is not responsible for non-performance in the event of force majeure circumstances such as: diseases, epidemics, natural disasters, strikes, military actions both in the countries subject to this contract and in their neighboring bordering countries, threatening the security of both countries, governmental decisions or any other unforeseen or insurmountable event of an extraordinary nature that occurred after the conclusion of the contract.
VIII. PRIVACY AND PERSONAL DATA
1. The tour operator processes the User's personal data in order to provide the products and services that they have applied for and that they use, to fulfill the contractual and pre-contractual obligations and to enjoy the rights and obligations under the contract, such as names, social security number/date of birth , data from an identity document, contact data - email address for correspondence. The processing of personal data is related only to the exercise of the rights of the party having the status of User and the persons on whose behalf the contract is concluded, and the Tour Operator in processing the same complies with the requirements of European and national legislation.
2. The tour operator does not process personal special categories of data, such as genetic, biometric and other sensitive data, with the exception of health status data for travel purposes, if such are necessary.
3. By signing these General Terms and Conditions, the User declares that:
- is familiar with the Tour Operator's approved and current POLICY FOR CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA, as of the date of signing the same,
- has familiarized all Tourists whose names appear in the CIHR with the CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA POLICY approved by the Tour Operator and is responsible for providing their personal data to the Tour operator and gives on his own behalf and on behalf of all Tourists whose names appear in the tickets and / or in CIHR consent, the Tour Operator to process and store their personal data.
Standard form for providing information in relation to package travel contracts
The offered combination of tourist services constitutes a tourist package within the meaning of Directive (EU) 2015/2302.
For this reason, you will benefit from all the rights guaranteed in the EU that apply to travel packages. In accordance with the legal requirements, the company "Koda Production" EOOD has taken the necessary protective measures to recover your payments and, if the travel package includes transport, to ensure your repatriation in case of bankruptcy.

Data: Your individualizing data (names, social security number or date of birth, identity card or international passport number, address, telephone, e-mail, photos).
Purpose for which the data is collected:
User registration;
Making contact with the user and sending information to him, including if he wishes - to send newsletters and advertising messages;
Conclusion and execution of a commercial transaction with a client;
Marketing statistics.
By filling out the Service Registration and Purchase Form, a contractual relationship is created between "Koda Production" EOOD and you, on the basis of which we process your personal data - Art. 6, para. 1, b. (b) GDPR.
Your data for issuing an invoice to an individual:
If you wish to be issued an invoice as an individual, you should provide your unique civil number.
Purpose for which the data is collected:
Issuing an invoice for making payments under a contract for the provision of services.
Basis for processing your personal data:
By filling in the registration form or by concluding a written contract, a contractual relationship is created between "Koda Production" EOOD and you, on the basis of which we process your personal data - art. 6, para. 1, b. (b) GDPR.
"Koda Production" EOOD does not collect or process personal data related to the following:
reveal racial or ethnic origin;
reveal political, religious or philosophical beliefs, or trade union membership;
genetic and biometric data, health data or data about sex life or sexual orientation.

International data transfers:
Transfers of personal data as described in this Privacy Policy may include overseas transfers of personal data to countries whose data protection laws are not as comprehensive as those of countries in the European Union. Where required by European law, we will only transfer personal data to recipients that provide an adequate level of data protection. In these cases, we enter into contractual agreements to ensure that your personal data remains protected in accordance with European standards.

Withdrawal of consent to the processing of your personal data:
If you do not wish all or part of your personal data, for which there is no legal or contractual basis for education or storage, to continue to be processed by "Koda Production" EOOD for specific or all processing purposes, you can at any time to withdraw your consent to processing by filling in a form that you can get at the office or by email.

Right of access:

Providing access to the data is free of charge, but "Koda Production" EOOD reserves the right to impose an administrative fee in case of repetitive or excessive requests.
Right to rectification or completion:
You can correct or complete inaccurate or incomplete personal data related to you by submitting a request to "Koda Production" EOOD
Right to erasure ("to be forgotten"):
You have the right to request from "Koda Production" EOOD the deletion of your personal data, and "Koda Production" EOOD has the obligation to delete them without undue delay, when any of the following grounds are present:
the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
You withdraw your consent on which the data processing is based and there is no other legal basis for the processing;
You object to the processing of your personal data, including for direct marketing purposes, and there are no overriding legal grounds for the processing;
the personal data were processed unlawfully;
personal data must be deleted in order to comply with a legal obligation under EU law or the law of a member state that applies to "Koda Production" EOOD;
personal data were collected in connection with the provision of information society services.
"Koda Production" EOOD is not obliged to delete personal data if it stores and processes it:
to exercise the right to freedom of expression and the right to information;
to comply with a legal obligation that requires processing provided for in EU or Member State law applicable to the Administrator or for the performance of a task in the public interest or in the exercise of official powers conferred on him;
for reasons of public interest in the field of public health;
for the purposes of archiving in the public interest, for scientific or historical research or for statistical purposes;
for the establishment, exercise or defense of legal claims.
In order to exercise your right to be "forgotten", you should submit a request to "Koda Production" EOOD as well as certify your identity and identity with the person to whom the data relates to "Koda Production" EOOD by presenting your identity card for identification purposes to an employee of the Company.
"Koda Production" EOOD does not delete the data that it has a legal obligation to store, including for protection in connection with legal claims made against it or to prove its rights.
Right to Limit:
You have the right to request that "Koda Production" EOOD limit the processing of your data when:
dispute the accuracy of the personal data, for a period that allows "Koda Production" EOOD to verify the accuracy of the personal data;
the processing is illegal, but you do not want your personal data to be deleted, but only to have its use restricted;
"Koda Production" EOOD no longer needs the personal data for the purposes of processing, but you require them to establish, exercise or defend your legal claims;
You have objected to the processing pending verification of whether the legal grounds of "Koda Production" EOOD take precedence over your interests.
Right of portability:
You can at any time download the data that is stored and processed for you in connection with using the services of "Koda Production" EOOD with a request by email.
You can request that "Koda Production" EOOD directly transfer your personal data to an administrator specified by you, when this is technically feasible.
Right to receive information:
You can ask "Koda Production" EOOD to inform you about all recipients to whom the personal data for which correction, deletion or restriction of processing has been requested has been disclosed. "Koda Production" EOOD may refuse to provide this information if it would be impossible or require disproportionately large efforts.
Right to object:
You can object at any time to the processing of personal data by "Koda Production" EOOD that relate to you, including if it is processed for the purposes of profiling or direct marketing.
Your rights in the event of a breach of the security of your personal data:
If "Koda Production" EOOD detects a violation of the security of your personal data, which may create a high risk for your rights and freedoms, we will notify you without undue delay about the violation, as well as about the measures that have been taken or are about to be taken.
"Koda Production" EOOD is not obliged to notify you if:
has taken appropriate technical and organizational measures to protect the data affected by the security breach;
has subsequently taken steps to ensure that the breach will not result in a high risk to your rights;
notification would require a disproportionate effort.
Persons to whom your personal data is provided:
For the provision of a tourist service and after a submitted and confirmed request by you, "Koda Production" EOOD transmits the necessary information to the relevant counterparty, which processes your data as an administrator for the purposes of fulfilling the contract.
Other provisions:
If you have a complaint related to the use of your information, we would like you to raise it with us to enable us to take the necessary action. But you can also contact the Commission for Personal Data Protection.
